Notice of Public Hearing on Requested Variance from Adirondack Park Agency (APA) Act and River Regulations Shoreline Restrictions Project Number 2016-17

Notice is hereby given that, pursuant to §806 of the Adirondack Park Agency Act (Article 27 of the Executive Law) and 9 NYCRR Parts 575, 576, and 577, the Adirondack Park Agency (APA) will hold a public hearing regarding the application of the Town of Warrensburg for a variance from the shoreline restrictions in Executive Law §806 and the restrictions and standards set out in the Wild, Scenic and Recreational Rivers Act regulations (9 NYCRR Part 577).

The public hearing will commence on April 19, 2016 at 1:00 p.m. in the Town of Warrensburg Town Hall located at 3797 Main Street, Warrensburg, NY 12885.

The variance site is located in the Town of Warrensburg, Warren County, on a 5.2 ± acre property in an area designated as Low Intensity Use on the Adirondack Park Land Use and Development Plan Map. The tax map number of the property is: Section 223.7 Block 1 Parcels 24, 18 and 29.

The project consists of the construction of a Town Park on the site of a pre-existing manufacturing plant. The project includes access roads, a pavilion, trails, a boardwalk and observation deck, two canoe and kayak put-ins and take-outs, and other recreational amenities. The project is in a recreational river area and a Low Intensity land use area. The proposed boardwalk and observation deck are both greater than 100 square feet, are within the 75 foot and 150 foot setbacks, and are closer to the water than the pre-existing plant was. The boardwalk will be approximately 17 foot from the mean high water mark of the Schroon River at its closest point and the boardwalk will be approximately 12.3 foot from the mean high water mark of the Schroon River at its closest point. The boardwalk and observation deck require a variance from the shorelines restrictions under both Executive Law §806 and the Rivers Act regulations. The entire project will need a rivers project permit under 9NYCRR §577.5(c)(1) and the pavilion is also a public building in a Low Intensity land use area, which is a Class B project under APA Act §810(2)(b)(6). The primary purpose of the hearing is to develop a record on the variance application; however, if the public wants to make comments regarding the entire project those comments will become part of the record.

Any person or public agency entitled to individual notice pursuant to 9NYCRR §576.5(d)(2), and, at the discretion of the APA or its hearing officer, any other persons or public agencies, may participate. The applicants and their authorized representative will have an opportunity to describe the proposal and how it comports with the variance criteria set forth in 9NYCRR Part 576. The APA or hearing officer will have authority to adopt such procedures as deemed necessary for the orderly conduct of the hearing, including the formal taking of testimony, sworn statements, cross examination of witnesses and reasonable limitations on testimony. The burden of demonstrating approvability under the variance criteria set forth in 9 NYCRR Part 576 rests with the applicants.

Any person may speak during the public comment period of this hearing, and may submit written comments before the hearing to the contact listed below until April 29, 2016. All written comment letters received by the close of the hearing will become part of the unsworn record and will be considered prior to any determination on the variance request. There will be a period of ten days after the hearing wherein the public may submit written comments to the APA regarding the variance application.

Pursuant to §301(2) of the State Administrative Procedure Act, interpreter services will be made available to persons who are hearing impaired at no charge upon written request to the APA within a reasonable time prior to the hearing.

Project Description: The applicant seeks to develop a public park, with an improved driveway with parking, two canoe and kayak put-ins and take-outs, stone paths signage, a raised boardwalk, a pavilion and an observation deck overlooking the Schroon River.

Rivers Act Project and Class B Regional Project requiring a permit:
The proposed public park is an open space recreational use and the proposed boardwalk and observation deck are accessory structures to that use in a recreational river area on lands classified Low Intensity use area. As such, the park and accessory structures require a Rivers Act project permit pursuant to 9 NYCRR § 577.4-5. The proposed pavilion is a public building in a Low Intensity land use area, which is a Class B project under Executive Law § 810(2)(b)(6).

Variances from Executive Law § 806 and the Rivers Act Regulations:
The raised boardwalk and observation deck are both within 75 feet of the mean high water mark of the Schroon River and therefore require a variance from both the 75 foot setback under Executive Law § 806 and the 150 foot setback under the Rivers Act regulations, 9 NYCRR § 577.6. The variance hearing will be held on Monday, April 19, at 1:00 pm in the Town of Warrensburg Town Hall located at 3797 Main Street, Warrensburg, NY 12885.

Negative Declaration

Essex County - The Town of Crown Point, as lead agency, has determined that the proposed Water System Improvements will not have a significant adverse environmental impact. The action involves improvements to Water District 1 & 2 in the Town of Crown Point. The project includes the development of a new well and water control building on an existing Water Utility Service site. The project also includes upgrade water mains and distribution with appurtenances including hydrants and pressure reducing valves within the community. The project is located along Creek Road, Fish Hatchery Lane, Sugar Hill Road, Route 9N/22 and Ferry Boulevard in the Town of Crown Point, New York.

Saratoga County - The Corinth Central School District, as lead agency, has determined that the proposed Corinth Central School District 2016 Pre Referendum Services will not have a significant adverse environmental impact. The Board of Education of the Corinth Central School District is considering undertaking a project consisting of the acquisition of a 7.5 ± acre parcel of real property located at 30 Saratoga Avenue, Corinth, New York and the construction thereon of an approximately 29,000 square foot new bus garage facility, together with related site improvements; the demolition of the existing bus garage facility and related improvements located at 26 Ash Street, Corinth, New York; and various repairs, replacements, renovations, upgrades, and other improvements to the existing Middle School/High School and Elementary School facilities located at 105 Oak Street and 356 Center Street, Corinth, New York, including building envelope and structural improvements, mechanical and plumbing system improvements, electrical system improvements, interior improvements, site improvements, and the rehabilitation of athletic courts and fields.
