Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 400 gallons of water per minute from the Hudson River for golf course irrigation. The golf course has been in operation for decades. No changes in current operations from recent years are proposed.

The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 gallons per day which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

Availability of Application Documents:

Project Description:

The applicant proposes construction of the Meadowdale Estates Residential Subdivision on a 58 acre parcel. Construction of the residential development and attendant features will result in permanent impact to 0.45 acres of federal wetlands on the parcel and 0.14 acres of temporary wetland impact to construct utilities for the site. Creation of 0.77 acres of wetland on site is proposed to mitigate for unavoidable wetland impacts and all other remaining wetlands on the site will be preserved. Extension of the Latham Water District, proposed to serve the development with municipal water, will require the Town to apply to the Department for a modification of their Water Withdrawal permit.
