Project Description:

The Department of Environmental Conservation (DEC) has prepared a draft permit and has made a tentative determination to issue a renewal and set a standard five year term to State Pollutant Discharge Elimination Systems (SPDES) permit (NY0106216).

The Elmira High School discharges non-contact cooling water via Outrall 001 to Coldbrook Creek, a class C water. DEC proposes to incorporate the following modifications to this permit: The permit has been reclassified from an industrial (discharge class 04) to a P/C/I (discharge class 02). The facility currently discharges 4-5 months of the year as opposed to the original permit which discharged all year. Permit pages, limits, requirements, and general conditions have been updated and reflect current permit language, DEC guidance, format and nomenclature. Details of changes are specified in the draft permit and fact sheet.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The applicant proposes to add approximately 1.7 acres of land not previously approved for mining to the total life-of-mine acreage at the Oaks Corners Quarry, for a total permitted acreage of approximately 434.3 acres. The applicant proposes to use the 1.7 acres to construct a new haul road within a former railroad bed and transport shot rock from the north phases of the mine to the primary crusher via haul trucks rather than the currently approved conveyor.

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

The applicant proposes maintenance dredging of two areas within the existing marina basin totaling 0.86 acres. The dredge material will be temporarily stockpiled on the applicant's property.
