Project Description:

The Department of Environmental Conservation (DEC) has prepared a draft permit and has made a tentative determination to issue a renewal to State Pollutant Discharge Elimination Systems (SPDES) permit (NY0025976) for the surface discharge of treated wastewater to the Hudson River, a class B water.

The facility discharges treated sewage through Outfall 001 and provides secondary treatment for a design flow of 6.0 mgd. Treatment consists of screening, comminuting chambers, grit removal, primary settling, step aeration, secondary settling, and seasonal disinfection. Sludge is digested aerobically, thickened, pressed and hauled to a landfill.

DEC proposes to incorporate the following modifications to this permit: Limits and monitoring for parameters have been updated. The disinfection period has been modified. The pretreatment program language has been updated. A mercury limit has been added, and a Mercury Minimization Plan has been added, in lieu of the existing Pollutant Minimization Plan for mercury. Whole Effluent Toxicity Testing has been added. A compliance schedule has been added for report submissions and for a Short-Term High Intensity Monitoring Program for parameters. Details of changes are specified in the draft permit and fact sheet.

The Department has made a tentative determination to approve this application for a new SPDES permit # NY-0280925 for Gas Land Petroleum Inc. to discharge up to 475 gallons per day of treated wastewater to an unnamed subtributary to Wappinger Creek (NYS Water Index # H-101-4-3-1, Class C) associated with the expansion of an existing convenience store at 233 Myers Corners Road. The receiving water is an intermittent stream, and therefore the intermittent stream effluent limit criteria apply. A draft SPDES permit with DEC proposed effluent limits and monitoring requirements is available for review at the DEC Region 3 headquarters in New Paltz. The permittee will be required to maintain records and report data to verify compliance with the SPDES permit conditions and discharge limits. The existing subsurface system, not regulated by DEC, will be discontinued.
