Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a renewal of the Title V permit held by the Buckeye Pipe Line Co facility, for the breakout station located at 3186 Gates Road in the town of Sennett, NY. This facility is a major facility because volatile organic compound (VOC) emissions are above the major source threshold of 50 tons of VOC per year. This facility is subject to 40 CFR 63 Subpart BBBBBB-National Emission Standards for Hazardous Air Pollutants for Source Category: Gasoline Distribution Bulk Terminals, Bulk Plants, and Pipeline Facilities as well as 40 CFR 60 Subpart Kb-Standards of Performance for Volatile Organic Liquid Storage Vessels (Including Petroleum Liquid Storage Vessels) for Which Construction, Reconstruction, or Modification Commenced After July 23, 1984. As part of this renewal, the facility has changed the method in which they calculate HAP emissions used to demonstrate they are not a major source subject to 40 CFR 63 Subpart R-National Emission Standards for Gasoline Distribution Facilities (Bulk Gasoline Terminals and Pipeline Breakout Stations).

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Article 23 Title 27 Mined Land Reclamation

Project Description:

The applicant proposes to develop and operate a 18.2 acre surface sand and gravel mine within a 66.6 acre parcel, approximately four miles west of Parrish, NY on the east side of County Route 11. The project site is the applicant's property on County Road 11 between Smith Road and Brecheimer Road. The mine will operate as a traditional surface excavation of sand and gravel using mechanical equipment standard for this type of mining operation. Materials will be not be mined from below the water table. On‑site processing will include screening and crushing at a rate not to exceed 150 tons per hours. Approximately 500,000 cubic yards of material will be mined from this site over the estimated 20 year operational life of the mine. Reclamation will be concurrent with mining operations. Final reclamation will restore the site and will reestablish vegetated open land and meadow habitat. Reclamation will include the replacement of stockpiled topsoil, and reseeding with an approved USDA SCS seed mixture. The reviewed Life-Of-Mine (LOM) area is 18.2 acres.
