Project Description:

Global Companies LLC (Global) proposes a modification of their State Pollutant Discharge Elimination System (SPDES) permit (NY No. 0021016) to replace the existing wastewater treatment system, currently consisting of a series of boilers, a combustion chamber, chemical addition, and supplemental off-site reclamation/treatment, with a constructed treatment wetlands (CTW) system to more effectively treat wastewater contaminated with fuels that contain ethanol. The CTW will consist of two 3,136 square feet cells to be constructed adjacent to the existing treatment facility. In addition to the two aerated CTW cells, major system components will include a tray air stripper to remove petroleum compounds, including volatile organic compounds (VOCs), from wastewater followed by treatment through a catalytic oxidizer (proposed control equipment to remove/destroy VOCs stripped from wastewater), transfer pump and a continued discharge of treated wastewater through the existing outfall to the Hudson River. No changes to the overall facility operations or parameters/composition of the type of wastewater being treated will occur as a result of this modification.

While the Department had determined the air stripper and associated control equipment (catalytic oxidizer) to be trivial activities in accordance with 6 NYCRR 201-3.3(c)(29)(ii), and not requiring a modification of the facilities existing air Title V Facility permit (DEC #4-0101-00112/00029), Global elected to document these trivial activities within their current air Title V permit and has submitted a request for a Minor permit modification.

The Department has made a tentative determination to issue a modification of the facility SPDES under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project.

A draft permit is available for inspection at the Region 4 office.

Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 1200 gallons per minute of water from an onsite irrigation pond and 175 gallons per minute from an onsite well for irrigation of the Olde Kinderhook Golf Club Facility. The facility has been in operation for since 1999. No changes in current operations from recent years are proposed.

The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 gallons per day which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

Project Description:

This project consists of the renewal of the existing air state facility permit for the Hancock Quarry located in the Town of Hancock, Delaware County. Plant operations include the crushing and screening of various aggregates as well as the production of asphaltic concrete in one of two batch plants. This permit renewal also incorporates several new pieces of processing equipment that are replacing existing equipment. Equipment added to the permit includes a new hot mix asphalt batch plant replacing the existing drum plant, a new crusher, screen, and three conveyors. Equipment removed from the permit includes a hot mix asphalt drum plant, two screens, three crushers, five storage bins, and three conveyors. All of the equipment operated on site is powered by line power.

In order to avoid being subject to Title V permitting requirements, the Hancock Quarry has accepted emissions caps on their emissions of carbon monoxide, oxides of nitrogen, and particulate matter. These emissions caps will ensure that the facility's annual actual emissions do not exceed the major facility threshold. The facility is required to maintain records and certify compliance with these emissions caps on an annual basis. The project is located on Green Flats Road.

The applicant proposes a modification to their State Pollutant Discharge Elimination System (SPDES) Permit to discharge 57,000 GPD of treated wastewater from the production plant into the Class B Susquehanna River, from outfall 001 at the applicant's facility located at 656 Co Hwy 33, Cooperstown, New York. This reflects an increase from the previously permitted 35,000 GPD. The applicant has also requested an increase in the daily maximum temperature limit at outfall 001 from the currently permitted 90°F to 109°F. Outfalls 002 and 003 discharge to groundwater. The applicant proposes to modify the existing flows at outfall 002 to include the flows previously discharged through outfall 003. Outfall 003 shall be retained as a back up system. No additional construction is proposed. The Department has made a tentative determination to issue a permit for a SPDES permit under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statue is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.
