Project Description:

The Department has made a tentative determination to approve an application to construct a single-story, single-family residence, an associated septic system, and a seasonal dock within an area of maintained lawn, affecting approximately 1,400 sq. ft. (0.032 ac.) of regulated adjacent area and 120 sq. ft. (0.003 ac.) of wetland area of Class 1 NYS Freshwater Wetland CS-2. The residence will be constructed on an existing residential lot that has existing water, and electric services. As mitigation for wetland and regulated adjacent area impacts, the applicant proposes to remove an existing 30 ft. by 40 ft. barn, failed septic system, and a large deposit of 50 or more rubber tires from Upper Cassadaga Lake. A 1,360 sq. ft. portion of the historically maintained lawn located nearest to, and within the regulated wetland boundary will be planted with native trees, shrubs, and herbaceous plantings for additional mitigation. The project is located at the facility address listed above.

As a tentative determination, the Department is seeking public comment prior to making a final decision on permit issuance.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Comments on this project must be submitted in writing to the Contact Person no later than Mar 10, 2016.

Project Description:

The Department has received an application and made a tentative determination to re-authorize an existing discharge of up to 1,500 gallons per day of treated sanitary wastewater to West Branch Cazenovia Creek, a Class B waterbody, from the Colden Country Inn located at 8815 State Road in the Town of Colden. The wastewater is treated through a septic tank/sand filter system. No modifications to the facility, the treatment system or the discharge are proposed as part of this permit re-authorization. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department is seeking public comments prior to making a final decision on permit issuance. A draft permit is available for review.
