Project Description:

The Department has made a tentative determination to approve this application for a new permit for a proposed withdrawal and discharge of up to 936,000 gallons per day of treated groundwater into the East River (Class I) via NYCDEP Outfall NC-082 from a treatment system consisting of settling tanks, bag filter housing and carbon adsorbers at the applicant's facility located at 416-420 Kent Ave. of Brooklyn where the applicant will temporarily dewater to facilitate construction of a two new multi-story buildings and various utilities. A draft permit is available for inspection and comment at the regional office.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.

SEQR Lead Agency: NYC Planning Commission

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Pumped groundwater is to be directed to an existing 3'-0" x 4'-9" combined sewer on W 33rd St at the intersection with 11th Ave and will be discharged to NYCDEP North River Water Pollution Control Plant in Manhattan.
