Project Description:

Orange County Soil & Water Conservation District (OCSWCD) proposes to construct an 80-foot wide forested floodplain bench along either side of a 2/3-mile stretch of the Wallkill River [Water Index No. H-139-13, Class C] beginning in the east near the confluence of Pochuck Creek, Cheechunk Canal, and the Wallkill River, and concluding in the west at the bridge carrying Pine Island Turnpike over the Wallkill River. The floodplain bench will be constructed by excavating down four to eight feet to the approximate bankfull elevation. It is estimated that 220,000 cubic yards will be excavated from the proposed floodplain bench locations.

The proposed floodplain bench creation will result in the disturbance of approximately 7.66-acres of agricultural land, 17.34-acres of upland forest, and 0.49-acres of forested wetland. In order to avoid and minimize potential impacts to the State-listed Indiana bat (NYS Endangered), the project will occur over a minimum of three years (or phases) to maintain and allow for the re-establishment of habitat suitable to the species. Tree clearing will be restricted to occur between October 1st and March 31st to avoid impacts to individual bats.

This project is the last of three distinct actions associated with the Orange County Wallkill River Flood Mitigation Project located within the Black Dirt Region of Orange County. Funding for the proposed project will be provided, in part, by a New York State Floodplain Management Grant.

In addition to the above noted permits, OCSWCD is required to obtain a Flood Control Land Use Permit (pursuant to Article 16, Section 0107.13 of the Environmental Conservation Law) from the NYSDEC Division of Water, Bureau of Flood Protection and Dam Safety, in order to conduct work within a State Flood Control Project, specifically the Wallkill Flood Damage Reduction Project.

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 3,900 gallons per minute of water from an on-site source & the Hudson River for mine dewatering, aggregate processing, and dust suppression at the Tomkins Cove Quarry facility. The facility has been in operation since at least 1986. No changes in current operations from recent years are proposed.

The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 gallons per day which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).
