The applicant proposes to re-establish a 68.7 acre sand and gravel mine in a previously mined site located on a 121 acre property on the west side of Oak Openings Road, approximately 1 mile north of the intersection with NYS Routes 5 & 20. The site would be mined by bulldozer, excavators, and trucks, along with material processing by portable crushing and screening equipment. The proposed hours of operation are 7:00 a.m to 6:00 p.m. Monday through Friday, and 8:00 a.m. to 2:00 p.m. on Saturdays, with no operations on Sundays or legal holidays. The proposed reclamation includes two ponds totaling approximately 14.7 acres, with the remainder of the site to be reclaimed as vegetated open space.

Project Description:

The applicant has applied for an initial permit for the continued withdrawal, from the Genesee River, via the Johnson-Seymour Raceway, an amount of water not to exceed 576,000 gallons per day for use in their cooling water application for cooling of the Rundel Library Facility. The Facility has been in operation since 1932. The facility draws from the raceway as it passes under the building before the raceway discharges back to the Genesee River through the window/openings in the building. The cooling water then discharges back to the river 30 feet downstream under a SPDES permit. No changes in current operations are proposed. The Department has determined that the Facility is not eligible for an Initial Permit under Section 15-501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000GPD which were properly reported to the Department prior to February 15, 2012. Therefore, the Department is reviewing the application as a new water withdrawal.

The Town of Rose has submitted a SPDES permit and Water Withdrawal permit applications for a proposed water source improvement project. The Department has made a tentative determination to issue a SPDES permit to the Town of Rose for the Water Treatment plant at the Catchpole Well site, located on Catchpole Road, to discharge backwash water from water filters to septic tanks, sand filters and ultimately to a tributary of Sodus Creek.

The applicant has applied for a new water withdrawal permit to take a combined supply of water of up to 712,800 gallons per day (GPD) from two well fields for use in the existing system of water for operation of the Rose-North Rose Water District and Water Treatment Facility.

As a tentative determination, the Department seeks comments prior to making a final decision. The file, including draft SPDES permit, is available for review and comment at NYSDEC Region 8.
