Project Description:

The applicant proposes to install a 12 slip docking facility to be used by current back lot owners of Hutton Bay. The dock will be 88 feet long and 4 feet wide with six 14 foot by 3 foot finger docks. The last 8 feet of the dock will widen out to 24 feet and act as a swimming platform. In addition, the applicant proposes to dredge an approximately 4,500 square foot area to gain a 2.5 - 3.0 foot depth for adequate dockage. The facility is located approximately 400 feet northeast of the Rush Creek Road and County Road 49 intersection, and adjacent to the Rushford Lake Public Beach.

No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

The applicant proposes to vertically expand an existing surface unconsolidated sand and gravel mine by ten feet across a 27.49 acre area within 43.8 acre Life-of-Mine area. The vertical expansion will occur in areas already affected by mining. No changes in mine operations, including traffic patterns, equipment, and vehicle access, are proposed. Dry processing of material will take place on-site using portable equipment. The reclamation land use objective for this site has been specified as being open space and wildlife habitat.

Project Description:

The Department has made a tentative determination to approve an application for the Green Lake Dam reconstruction and dredging project which will remove approximately 124,000 cubic yards of dredge material. Repairs to the dam will be made to meet NYSDEC guidelines. The project will include armoring the upstream face of the dam, flattening the downstream slope of the dam, installation of a new spillway and basin, and pedestrian bridge replacement. The project is located at 200 Lake Drive in the Town of Orchard Park. As a tentative determination, the Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of an activity for which a permit is sought.
