Project Description:

The applicant proposes to expand the life of mine of an existing sand and gravel mine by 18-acres for a total of 25-acre life of mine on a 194-acre parcel owned by the applicant. The affected area would increase to 12 acres over this permit term. An existing berm would be moved closer to the Correctional Facility, keeping a 25' setback from the property line. Operating hours are requested to be extended from 7:30 AM -5:00 PM to 7:30 AM-5:30 PM Monday - Friday and from 8:00 AM - 1:00 PM to 8:00 AM to 2:00 PM on Saturday. No mining will occur on legal holidays or Sunday. The facility is located on the west side of Bare Hill Road, north of Upstate Correctional Facility.

Evaluation using a Structural-Archaeological Assessment Form or other information has concluded that the proposed activity will not impact registered, eligible or inventoried archaeological sites or historic structures.

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The current project site includes approximately 5895 acres of leased private lands that are roughly bound by State Route 11 to the north, the Chateauguay River to the east, Brainardsville Road to the south and the Burke/Chateauguay town boundary to the west. The project is situated within the St. Lawrence-Champlain Lowlands, north of the Adirondack Park boundary. The project area is a mixture of forest land and agricultural fields.

In addition to the 37 turbines, each with a nameplate capacity of 2.1 megawatts, the project will include construction and operation of a single permanent meteorological tower, a system of gravel access roads, electrical collection and communication cables, and a substation. Temporary impacts will include a laydown area for construction.

State Historic Preservation Act (SHPA) Determination:

Based on the information provided in cultural resources survey reports for this project, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have an impact on registered or eligible archaeological sites or historic structures. Measures have been undertaken in consultation with OPRHP to avoid or mitigate impacts to registered or eligible resources. These agreed upon measures conclude the SHPA review.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

The purpose of this Permit Modification is to establish the conditions under which ESMI must test PCB contaminated material emissions for overall control and for the formation of Dioxins.

It also establishes allowable cumulative impacts taking into account emissions from this facility combined with existing background concentrations.

New limits on process feed rates also make existing limits on chlorine and benzo(a)pyrene unnecessary and they are being eliminated.
