Project Description:

The applicant proposes to modify an existing Article 15 Protection of Waters Permit to withdraw water from the Class C(TS) Schoharie Creek for the purposes of maintaining snowmaking operations by changing the permitted conservation flow. As currently permitted, during snowmaking season (October 15 through April 15 annually) the applicant cannot withdraw water unless the instream flow is 15 cfs or greater, with the threshold shifting after January 1st to 20 cfs or greater when the air temperature is 0° Fahrenheit or lower. The applicant proposes to modify the permit to establish a 20 cfs minimum flow for the Schoharie Creek throughout snowmaking season. In exchange, the applicant has requested to eliminate the second intake and reservoir currently required by Special Condition #11 of the existing permit, issued February 8, 2011. Previous State Environmental Quality Review (SEQR) for this project resulted in an Environmental Impact Statement (EIS). SEQR Findings and Protection of Waters Permit were issued by the Department on February 8, 2011. The Department will rely upon the Draft EIS and Final EIS, which discussed alternatives, as well as the modification application documents in reaching a decision and making amended findings. The applicant has also applied for an initial permit for the continued withdrawal of 12,960,000 Gallons per Day (GPD) of water for the operation of the Hunter Mountain facility. This facility has been in operation since 1959. No changes in current operations are proposed. Additional requirements regarding passby flows in or withdrawals from Schoharie Creek/Dolans Lake as described in the above proposal to modify an existing Article 15 Protection of Waters Permit shall be incorporated by reference. The department has determined that the Facility is eligible for an Initial Permit under Section 15-501.9 of Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 GPD which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume. The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
