Project Description:

The applicant proposes to renew his sand and gravel mining permit and to include a 19 acre expansion to the life of mine limits, and to excavate into the groundwater table within the currently permitted mining area to make a 2.9 acre pond. The facility is currently permitted for mining on 17.8 acres out of approximately 221 acres owned by the applicant at this location. The mining methods and material processing will remain the same as the current operation. The facility entrance is located on the north side of Brownell Road, approximately 3300 feet east of the intersection with State Route 474, and 460 west of the intersection with Rhebergen Road.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Feb 26, 2016.

Project Description:

The applicant proposes to construct an armor stone and rip rap revetment to stabilize approximately 300 feet of Lake Ontario shoreline. The design for this revetment includes a four ton stone toe that will be keyed into the lake bottom, two to four ton armor stone placed behind the toe stone, rip-rap placed behind the armor stone, and vegetative plantings.

As a tentative determination, the Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of an activity for which a permit is sought.
