Project Description:

Edger Civil & Utility, LLC is proposing to open a new 7.6 acre sand and gravel mine on a 26.5 acre parcel of land at the south end of Industrial Park Rd, in the Town of Horseheads. The new mine would be located immediately north of the existing Pall-Buch Gravel Pit (DEC Mine ID #80705), which is also operated by Edger Civil & Utility, LLC. Use of a front end loader and long-reach excavator is proposed for extraction of sand and gravel. The final depth of excavation would be 830 feet above sea level, which is on average 35 feet below current ground and 30 feet below the local ground water table. Approximately 314,600 cubic yards of minerals would be excavated from the site over a 10-12 year period, depending on market demand. Screening, crushing and washing of minerals extracted from the new 7.6 acre mine would occur at existing processing plant at the Pall-Buch Pit. Final reclamation would result in a new 7.0 acre open water pond on land that is currently used for farming. The hours of operation at the new mine would be the same as the currently approved hours of operation at the Pall-Buch pit, Monday - Saturday 7:00 a.m. to 5:00 p.m. with no operation on Sundays or legal holidays. The proposed project would not require any additional truck traffic or change is traffic patterns. The existing haul road off Industrial Park Rd would be used to transport material from the Narde Mine to the Pall-Buch Pit for processing.

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. The report of the survey is on file. No archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The applicant proposes to install approximately 700 square feet of solar panels mounted on 16 helical piers in an active agricultural field. Approximately 285 feet of conduit will be buried in a 2 foot deep, 1 foot wide trench extending from the solar panels to the residence. The solar panels and conduit will be located within the 100 foot adjacent area of NYSDEC Freshwater Wetland CL-11, a Class 3 wetland.

Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 12,816,000 GPD of water from ponds connected to Mud Creek for operation of the Bristol Mountain Ski Resort Facility including snow making, compressor cooling, and fire protection system needs. The Facility has been in operation since 1964. No changes in current operations are proposed. The Department has determined that the Facility is eligible for an Initial Permit under Section 15-501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 GPD which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.
