Project Description:

The applicant proposes filling a 0.02 acre portion of an in-stream pond with 400 cubic yards of sand and gravel; and constructing two concrete walls, a 45 linear foot wall to separate the 0.02 acre portion of the fill area, and a 57 linear foot wall along the east bank of the pond to address bank erosion. These activities are proposed for Hunns Creek, Water Index No. H-101-30, Class B, in the Town of Stamford, Dutchess County. An existing 36-inch diameter high-density HDPE culvert in the area of proposed fill will be lengthened approximately 35 feet to extend out to the edge of the fill zone and continue its outlet into the mill pond. A temporary haul road will be constructed.

Project Description:

The Department has made a tentative determination to approve this application for a re-issuance of SPDES permit # NY 003 1739 for the Chelsea Ridge Apartments at Chelsea Ridge Drive, Wappingers Falls, for the discharge of 112,000 gallons per day (gpd) of treated sanitary waste to an unnamed tributary of the Hudson River, NYS WIN # H-99, Class C. The previous permit expired August 31, 2014 and no changes in the operation of the facility are proposed.

The permit has been updated to DEC's current standards and two changes made to the effluent limits: 1) The expired permit required Interim Temperature Monitoring but the erroneously did not include Temperature Monitoring in the Final Limits. This typographical error has been corrected by the addition of a Monitoring Requirement for Temperature; Sample frequency for Dissolved Oxygen has been changed from Daily to Monthly in accordance with NYS TOGS1.3.3.

A draft SPDES permit with DEC proposed effluent limits and monitoring requirements is available for review at the DEC Region 3 headquarters in New Paltz.

The Department has prepared a draft permit and has made a tentative determination to issue a modification to the State Facility Permit for Fishkill Downstate Correctional Facility. Permitted air emission sources at the facility include five boilers, seven generators and two paint spray booths.

This modification serves to further detail the source listing. One 1250 kW generator has been added to the permit. In addition, the capping condition for greenhouse gas emissions has been removed. On June 23, 2014, the U.S. Supreme Court held that the EPA may not treat GHGs as an air pollutant for purposes of determining whether a stationary source is a major source required to obtain a Title V permit, therefor no cap is required. Emission caps for NOx, CO, SO2 and VOCs remain in the permit. The facility's past data show emissions for all regulated pollutants to be consistently below their permitted caps.

By acceptance of this permit, the permittee agrees that the permit is contingent upon strict compliance with the ECL, all applicable regulations, the General Conditions specified and any Special Conditions included as part of this permit.

The Department has prepared a draft permit and made a tentative determination to issue a renewal of the Title V permit held by Par Pharmaceutical, Inc. is a manufacturer as well as a research and development facility of pharmaceutical products. The facility is located in Chestnut Ridge, Rockland County. Potential emissions of Volatile Organic Compounds exceed major source thresholds subjecting the facility to Title V permitting. The facility emissions of individual and total Hazardous Air Pollutants (HAPs) are limited below major source thresholds. The facility is subject to numerous monitoring and recordkeeping requirement under 6NYCRR Parts 201 and 212. The Standard Industrial Code (SIC) is 2834 - Pharmaceutical Preparations.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

The project sponsor proposes to construct a single family residence with associated garage, drilled well, and septic system.
