The applicant proposes to install an erosion-control retaining wall along the north bank of an unnamed Class C tributary to Owasco Lake. The dry-stacked concrete block wall will be approx. 120' long, and will vary between 8'-4' in height. Stream bankfull width will be maintained, and all existing debris along the bank will be removed from the site and landfilled.

Project Description:

The New York State Department of Environmental Conservation (DEC) is proposing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit NY0004243), pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS).

The Kerry Bio-Science facility manufactures products for food and pharmaceutical applications. The facility discharges treated process water, cooling, sanitary and stormwater combined effluent wastewater to the Chenango River, a class C water. Treatment at the facility consists of activated sludge and trickling filtration.

The following changes to the permit are proposed: Discharge notification requirements, general requirements, Industrial Best Management Practices, and treatment plant schematic have been updated. A short term high intensity monitoring requirement has been added for Total and Fecal Coliforms. Details of changes are specified in the draft permit and fact sheet.

This permit is a reissuance of a previously issued permit to discharge treated sanitary wastewater to Oneida Lake. The permit is also being corrected to reflect seasonal limits for Ammonia rather than yearly. The Department has made a tentative determination to issue a permit for a SPDES permit under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statue is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval or endorsement of the activity for which a permit is sought or for the overall proposed project. Bear's Sleepy Hollow Campground will discharge treated sanitary waste of up to 10,000 gallons per day and 475 gallons per day from two septic tank and sand filter systems. A draft permit is available for review and public comment.
