Project Description:

DEC received an application for renewal of an existing Air Title V permit for the facility located at 9644 Main Street in the hamlet of Beaver Falls. The facility consists of a Siemens V64.3 gas turbine, deltak heat recovery steam generator (HRSG), Coen duct burner, and Ansaldo steam generator. Facility supplies electricity to the open market and process steam to a thermal host. The gas turbine/HRSG unit is equipped with SCR to control NOx emissions.

The facility is a major facility subject to the requirements of Title V. The facility's pollutant emissions which exceed the major source threshold for Title V are: Nitrogen Oxides and Carbon Monoxide. The facility is also subject to the Acid Deposition Reduction Act (ADR), Part 237 and CAIR, Part 243, 244, and 245. The facility is also subject to the 40 CFR 60, Subpart Dc, and GG.

The Department has prepared a draft permit and has made a tentative determination to issue a renewal.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. The Draft Permit and Permit Review Report may be viewed and printed from the Department web site at: http://www.dec.ny.gov/chemical/32249.html.

DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below. Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

This Department has received an application for a permit and has drafted an Article 19 (Air Pollution Control) of the Environmental Conservation Law and the Federal Clean Air Act Amendments, an Air Title V Permit, at the facility located at Oneida County Water Pollution Control Plant, the facility located at 51 Leland Ave., Utica , NY 13502.

The Department has made a tentative determination to approve the application of the Oneida County Sewer District , which provides activated sludge wastewater treatment from residential commercial and industrial facilities in a portion of Oneida County. The approval of the Title V Permit allows the operations and of emission units 1-00000 and 2-00000 which includes: exempt wastewater treatment operations including mechanical bar screens, grit removal, primary clarification, diffused air biotreatment, and chlorination/dechlorination, and Combustion operations consisting of two (2) fluidized bed incinerators and three (3) exempt boilers (<10 mmbtu/hr) are present onsite. The facility is subject to NSPS 40 CFR 60 Subpart O, 40 CFR 68, and 40 CFR 82. The incinerators are subject NSPS standard 40 CFR 60 Subpart MMMM, and NESHAP standards 61 Subpart C and 40 CFR 61 Subpart E. The boilers are subject to NESHAP standard 40 CFR 63 subpart JJJJJJ, and the emergency generator is subject to NESHAP standard 40 CFR 63 subpart ZZZZ.
