Project Description:

The applicant proposes to improve an existing minor commercial entrance resulting in the permanent impact of approximately 4,100 square feet of freshwater wetland CH-8's 100-foot adjacent area, all of which is already disturbed (i.e., mowed or gravel). The applicant also proposes to install a new wastewater discharge pipe to convey treated effluent to a man-made pond within the subject property boundary. Approximately 125 square feet of adjacent area will be permanently impacted and 30 square feet of CH-8 will be permanently impacted by construction of the discharge pipe outfall. Approximately 195 cubic yards of soil and rock rip-rap fill will be placed at the discharge location to match grades and stabilize the outfall.

The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant proposes to renew and modify an existing permit to discharge 75,000 gallons per day treated sanitary and process wastewater to a tributary of Thorpe Creek, Class C, from a treatment plant which utilizes a centrifuge, primary treatment, biological treatment, UV disinfection, heat exchanger for cooling and post aeration. Applicant facility is located at 3169 State Route 145, East Durham, NY. The applicant plans to expand the facility to accommodate an increase in production with associated increases in wastewater flow (50,000gpd to 75,000gpd).

The department has made a tentative determination to re-issue and modify a permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify department approval for or endorsement of the activity for which as permit is sought or for the overall proposed project. A draft permit is available for inspection and comment at the Region 4 office. Refer to this application by application number listed above and SPDES number NY-019 1973.

Project Description:

The Department has received renewal, Title V and Title IV (Acid Rain) permit applications for the existing, Castleton Power, LLC an electric generating facility located at 1902 River Road, Castleton-on-Hudson, Rensselaer County, New York 12033. The Castleton Power Facility is a combined cycle, electric generating plant rated at 67 MW. The facility began commercial operation in 1991. The facility operates one General Electric Frame Model PG6541B gas turbine firing primarily natural gas with distillate oil as an alternative fuel. The gas turbine utilizes steam injection for NOx emission control. The power unit includes a 125 MMBTU/hr natural gas fired duct burner and a heat recovery steam turbine generator. The facility also operates a low NOx, gas fired auxiliary boiler rated at 24.4 MMBTU/hr for space heating and to provide steam to the gas turbine during startup. This permit renewal includes a NYCRR Part 227, Reasonable Available Control Technology (RACT) annual NOx limit of 157 tons/year.

In accordance with NYCRR Parts 621.5 (d) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with the applicable requirements of the Clean Air Act or NYCRR Part 201. The application and draft permit are available for review at the NYSDEC Region 4 Office, 1130 North Westcott Road, Schenectady, NY 12306.
