Applicant proposes to install new rock revetment of 1- to 3-ton rock along approximately 150 feet of shoreline on Lake Ontario. The rock will be placed at or below mean high water level for erosion control and to reinforce the existing slope. A 3- to 4-foot strip of deep-rooted vegetation will be planted at the top of the revetment as additional erosion protection.

Project Description:

Applicant proposes to install seventeen (17) rock vanes, eight (8) rock riffles, three (3) cross vanes, two (2) stacked rock walls, and two (2) toe rock walls to stabilize an approximately 2, 155-foot section of Catlin Mill Creek, a Class C(TS) stream. Erosion and sediment controls will be used to prevent any suspended material from leaving the project area. Disturbed areas will be seeded to promote vegetation growth and stabilize soils. Project was designed by and project oversight will be done by Steuben County Soil & Water Conservation District.

Project Description:

The Department has received an application from Dendis Sand & Gravel, Inc. to develop and operate a 44.8 acre surface sand and gravel mine within two adjoining parcels of property totaling 235.3 acres of land in the Town of Galen. The proposed mine is located on the west side of Marble Rd., approximately 0.3 miles south of Lyons Marengo Rd.

Excavation will be by a front end loader, excavator, and drag line, with materials mined to a maximum final depth of 335 feet above mean sea level, which is approximately 67 feet below the current surface and 61 feet below the local water table. The proposed mining operations would remove 100,000 tons of sand and gravel from the mine annually, over an approximately 30 year operational life. Screening and washing of the excavated materials is proposed. Prior to the start of processing operations, topsoil and overburden berms will be placed along the perimeter of the mine area to function as an erosion control practice.

Final reclamation would result in creation of a 36.5 acre open water pond, in an area that is currently used for agricultural production. The remaining affected land surrounding the pond will be graded no steeper than 1 vertical to 1.5 horizontal, and seeded to establish permanent vegetative cover.

The Mining Plan Map shows that grading will allow drainage towards the proposed pond within the mined area. There are no streams or NY State regulated freshwater wetlands within the proposed mining limits. A Stormwater Pollution Prevent Plan (SWPPP) has been developed to control runoff and avoid impacts to the adjacent wetlands and stream (Pond Brook). The proposed hours of operation are 6 AM to 6 PM Monday through Friday, Saturday 7 AM to 3 PM as needed, with no work on Sundays or legal holidays.

The application is available for review at the Region 8 NYSDEC office, and a copy of the application materials has been sent to the Town of Galen.

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
