Project Description:

Applicant proposes to install a pervious access route to a new green burial section of the Riverside Cemetery. This access route requires placement of soil within 0.01 acres of State Freshwater RH-8 (Class 2). The access route will also impact the 100-foot adjacent area of RH-8, including regrading and fill with soil of 0.58 acres of forested adjacent area and 0.13 acres of lawn, for a total of 0.71 acres of 100-foot adjacent area. Erosion and sediment controls will be used to minimize potential impacts to the wetland. Planting in the disturbed areas will include native grasses and wildflowers.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Dec 31, 2015.
