Project Description:

The Department has made a tentative determination to issue the permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation Law. The approved application is for a permittee initiated modification to an existing discharge of 10,000 (gpd) gallons per day of treated landfill leachate into the Mohawk River, a class B waterbody from a biological wetland treatment system located at the applicant's facility in the Town of Frankfort, Herkimer County.

Changes include: changing the treatment system from a contracted treatment wetlands to a submerged bed biofilter with recirculation; relocation of Outfall 1; installation of a flow meter on the effluent chamber bypass line; reduced limits for BOD5 limits and Total Suspended Solids (TSS); revised seasonal ammonia (as N) limits; removal of limits and monitoring for: aluminum, barium, chromium, cobalt, iron, lead, mercury, nickel, selenium, thallium, vanadium, zinc, arsenic, cyanide, pyridine, sulfide, and alpha-terpineol; and reduction of sampling frequency to monthly for all parameters except Flow, BOD, & TSS which shall remain weekly.

This tentative determination indicates that a discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project. State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

It has been determined that the proposed action is not subject to CP-29.

Project Description:

Build an 18 slip boathouse and restroom. An upland area will be dredged to accommodate the boathouse with a small channel connected to open water in Henderson Harbor. The 24' x 24' restroom will be constructed in the 100' adjacent area to State Regulated Wetland H-4. The septic tank and distribution field will be built upland.

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.
