Project Description:

The Department of Environmental Conservation (DEC) has prepared a draft permit and has made a tentative determination to issue a renewal to State Pollutant Discharge Elimination Systems (SPDES) permit (NY#0020290) for the surface discharge of 10 mgd of treated wastewater to the Mohawk River, a class C water.

The Amsterdam Wastewater Treatment Plant discharges treated sewage through Outfall 001. The sewage collection system consists of combined sewers. Treatment at the facility consists of activated sludge, grit removal, scum collection and disposal. Sludge is dewatered with a belt press and disposed of at landfill.

DEC proposes to incorporate the following modifications to this permit: Concentration and mass monitoring for parameters have been added. Seasonal disinfection requirements and seasonal limits for parameters have been added. A Schedule of Compliance has been added for fecal coliform, total residual chlorine and BOD5, total suspended solids. Stormwater Pollution Prevention Plan requirements have been added. Sampling frequency for nitrogen (ammonia), copper, zinc and bis (2-ethylhexyl) phthalate has been reduced. Whole Effluent Toxicity testing years have been changed. State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The applicant proposes to restore a former manufacturing building into 67 residential units, and to restore 168' of existing seawall and construct 37' of return wall along the Hudson River to further reinforce and stabilize the site. The project is located at 599 River Street, City of Troy, Rensselaer County.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Housing Trust Fund Corporation

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.
