Addition of a New Part 576 to 6 NYCRR

Pursuant to Environmental Conservation Law Section 9-1710, the New York State Department of Environmental Conservation (NYS DEC) hereby gives notice of the following:

The proposed rulemaking for Aquatic Invasive Species (AIS) Spread Prevention requires that "reasonable precautions" are taken prior to placing a watercraft into public waters to prevent the spread of AIS. There will be a 45 day public comment period from December 16, 2015 to January 30, 2016.

Proposed Rulemaking: New 6 NYCRR Part 490, Projected Sea-level Rise

New York State Department of Environmental Conservation (NYS DEC) proposes to create a new 6 NYCRR Part 490, Projected Sea-level Rise, to adopt science-based projections of sea-level rise, in accordance with Environmental Conservation Law §3-0319.

The Notice of Proposed Rule Making was published in the November 10, 2015 edition of the State Register. Written public comments on this regulation will be accepted until 5:00 p.m. on December 28, 2015. Public Comment Period Extended for Water Withdrawal TOGS 1.3.12

The public comment period for TOGS 1.3.12 has been extended to January 20, 2016. Written comments on TOGS 1.3.12 must be submitted to the contact listed below by close of business on that date.

TOGS 1.3.12 is a guidance document developed by New York State Department of Environmental Conservation (NYS DEC) to assist staff in implementing the requirements of the laws and regulations established in Environmental Conservation Law (ECL) Section 15-1501 and Regulations 6 NYCRR Part 601. When significant withdrawals occur from a water body, consideration must be given to the amount of water that should be allowed to continue downstream (passby flows or reservoir releases) to provide protection for aquatic habitats and in consideration of other withdrawals. This particular document (TOGS 1.3.12) provides guidance on how NYS DEC will determine these protective flows or releases and incorporate adequate requirements into corresponding water withdrawal permits.
