Project Description:

The applicant is proposing to undertake the following rehabiliation work on the existing Dam at Ontario County Park:1) Replacement of an existing 30-inch driveway culvert at the end of the existing auxiliary spillway channel with a new 36-inch culvert; 2) Cleaning and re-grading of the auxiliary spillway channel to increase capacity; 3) Installation of approximately 600 linear feet of light stone fill in the spillway channel for erosion control; 4) Construction of a single spillway weir at the location of the existing auxiliary spillway; 5) Clean and close the existing auxiliary spillway (riser and conduit) by filling with grout; 6) Repair rodent burrows in the dam and place light stone fill on the upstream slope for erosion protection. Updates to the Emergency Action Plan are also being made for this facility in accordance with NYS Dam Safety Regulations.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Project Description:

In order to facilitate the construction of a 72,000 square foot commercial building and associated parking lot and access road, the applicant proposes to relocate approximately 550 linear feet of a NYSDEC Class C, non-navigable stream along the western side of the parcel. The relocated stream, also on the western portion of the parcel, will be approximately 580 linear feet, including several meanders. An additional 90 linear feet of stream will be directed through a culvert placed underneath the proposed driveway.

State Historic Preservation Act (SHPA) Determination:

Evaluation using a Structural-Archaeological Assessment Form or other information has concluded that the proposed activity will not impact registered, eligible or inventoried archaeological sites or historic structures.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
