State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant is proposing disturbances to the regulated 100-foot adjacent area of NYS Freshwater Wetland HJ-37, Class II, in association to the replacement and relocation of an existing water supply line. The new water line will be installed under Fishkill Creek [NYS Water Index #: H-95, Class C(T)] via hydraulic directional drilling (HDD), however, the bed or banks of the streams will not be disturbed. Disturbances to the regulated area of the wetland include excavation of boring pits associated with the HDD process (within the existing railroad bed) and borings for the installation of the water line. This project is located approximately 0.85 mile north of State Route 52 along the IBM and Con Edison right-of-way, in the Town of East Fishkill, Dutchess County.

Project Description:

The applicant proposes a new 8,710 gallon-per-day sanitary waste discharge to groundwater and disturbance to NYS freshwater wetland GO-12, Class 2, adjacent area associated with development of a 30-unit residential facility. Total adjacent area disturbance is 0.45 acre and is for establishment of dog park, community garden, stormwater features, and improvements to existing utilities and roadway. The applicant also requests reauthorization of the previously-permitted discharge of 1,370 gallons-per-day to an existing system serving the 5-unit condominium and commercial office space. The proposed sanitary discharges qualify for the NYS General Permit for groundwater discharge of treated sanitary waste - GP-0-15-001.
