Project Description:

The Department has made a tentative determination to approve an application for an Air State Facility permit to the Ingersoll Rand Engineered Centrifugal Compression (IRCO) facility in Cheektowaga. The facility manufactures centrifugal air compressors. Manufacturing processes regulated by this permit include electroplating, surface coating, packaging, and metal machining and cutting. Due to changes to 6NYCRR Part 201-4, the facility was required to obtain an Air State Facility Permit due to exceedance of Subpart 201-9 thresholds for Persistent, Bioaccumulative, and Toxic (PBT) compounds.

The facility has four emission units. The first unit consists of a hard chrome electroplating process, subject to National Emission Standards for Hazardous Air Pollutants 40CFR63 Subpart N and 6NYCRR Part 212, and controlled by a packed bed scrubber. The second unit includes four paint booths that are subject to 6NYCRR Subpart 228-1. The third unit includes a foam packing process subject to 6NYCRR Part 212 that involves batch mixing of a polymeric polyisocyanate packaging material dispensed into packing crates to protect manufactured parts during shipment. The fourth unit consists of non-exempt machine tools subject to 6NYCRR Part 212.

This permit establishes a lesser degree of control per 6 NYCRR Part 228-1.5(e) for one specific extreme performance coating. A detailed process-specific Reasonably Available Control Technology (RACT) analysis successfully demonstrated the technical and economic infeasibility of controlling volatile organic compound (VOC) emissions from the one specific extreme performance coating.

Emission caps which limit annual potential emissions to avoid requirements of 6NYCRR Part 201-6. Actual emissions of VOCs will be less than 49.5 tons per year, total hazardous air pollutants (HAPs) are limited to less than 24.5 tons per year, and each individual HAP is limited to less than 9.5 tons per year. IRCO is required to annually certify continuous compliance with the emission limits established in this permit through use of a 12-month rolling total emission rate calculated on a monthly basis.

The Department is seeking public comment prior to making a final decision on permit issuance. A draft permit is available for review.

Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Comments on this project must be submitted in writing to the Contact Person no later than Dec 11, 2015.
