As a tentative determination the Department seeks comments prior to making a final decision.

Project Description:

The Department proposes to modify the State Facility Air Permit for the Rochester Psychiatric Center, a psychiatric hospital located at 1600 South Ave. in the City of Rochester, Monroe County. The facility uses three 14.7 MMBtu/hr dual fuel Cleaver Brooks boilers that burn either #2 fuel oil or natural gas to heat the facility. The Department proposes to modify the Air State Facility Permit to change the annual reporting date from February 22 to January 30th to make compliance reporting less complicated. The permit will also be modified to include a new 10 year expiration date, to add the new sulfur in fuel restrictions, to add the NESHAPS subpart JJJJJJ and NSPS Subparts IIII and JJJJ requirements. In addition, a second Mitsubishi generator will be authorized for enrollment in the demand reduction program which may increase usage of the generator, therefore additional requirements will be added. The permit will retain previously granted Emission Reductions Credits (ERCs) from the existing permit.

The permit included federally enforceable permit conditions to "cap" the facility's emissions of Sulfur Dioxide (SO2) and Oxides of Nitrogen (NOx) to less than 100 and 40 tons per year (tpy) which is below the thresholds of Title V and 6 NYCRR Part 227-2, NOx RACT regulations. The emission cap will not change, however, the method of calculation will be changed to be more comprehensive and will based on fuel usage, emissions factors, and recordkeeping for all units.

By accepting these state and federally enforceable limits, the facility will continue to not be subject to Title V or 6 NYCRR Part 227-2 NOx RACT regulations. The application and draft permit are available for review at the Region 8 office located at 6274 East Avon - Lima Rd., Avon, NY, 14414.

Project Description:

The applicant proposes to replace an existing natural gas transmission pipeline in the Town of Rathbone with approximately 10,500 linear feet of 6 inch steel gas main. With the exception of the pipeline through NYSDEC Regulated Freshwater Wetland RB-12, the proposed pipeline will be installed parallel to the existing pipeline. Within wetland RB-12, the pipeline will bypass the existing pond. The project will impact approximately 0.59 acre of NYSDEC Regulated Freshwater Wetland RB-12 and 0.50 acre of wetland adjacent area associated with trenching and clearance of the right-of-way. The project will begin approximately 500 feet east of South Road and approximately 1500 feet north of Steuben County Road 21. The project will end at County Route 80.
