Project Description:

The New York State Department of Environmental Conservation (DEC) is proposing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit issued to Linde LLC (SPDES No. NY 008 4271), pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS).

The facility has a surface water discharge (Outfall 001) of industrial wastewater to an unmapped tributary of the Coeymans Creek, a class C water, with an expected flow rate of up to 36,000 gallons per day. Sanitary wastewater from the facility is discharged to a subsurface absorption treatment and disposal system (Outfall 002). The facility has three stormwater outfalls (Outfalls 003-005) that also discharge to unmapped tributaries of the Coeymans Creek.

The following changes to the permit are proposed:

Effluent limitations for total dissolved solids, total copper, total selenium, and total zinc, in addition to whole effluent toxicity testing, have been added to Outfall 001. Total residual chlorine discharged through Outfall 001 is now subject to a more stringent water quality based effluent limitation.

Two additional stormwater outfalls (Outfalls 004 and 005) have been added and monitoring requirements for all stormwater outfalls have been added to be consistent with the monitoring required by the SPDES Multi Sector General Permit for Stormwater Discharges from Industrial Activity for this type of industry.

The permit has also been updated to include the most up to date regulatory language and Industrial Best Management Practices.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The Department has prepared a draft permit and made a tentative determination to issue a renewal of the Title V operating permit for the Keymark Corporation Plant located in Fonda. Keymark is a manufacturer of extruded aluminum products. Facility operations include an aluminum melting and homogenizing furnace, two surface coating lines, an anodizing line, and other miscellaneous emission sources. This renewal does not propose any changes to the operations at the facility or the regulations that apply to them.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below.
