Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a modification to an existing federally enforceable Air State Facility permit for the Holimont property located in Ellicottville, New York. The facility operates three large internal combustion engines to generate electricity for all of the ski and snowmaking operations. This permit modification is for the conversion of the diesel generator engine to a dual fuel (diesel and natural gas) engine, and the addition of oxidizing catalysts to the three engines.

The facility will limit emissions of oxides of nitrogen (NOx) below the major stationary source applicability threshold for NOx of 100 tons per year (tpy) and by doing so will not be subject to the Title V Air permitting under 6NYCRR Part 201-6, NOx Reasonably Available Control Technology (RACT) under 6NYCRR Part 227-2 and applicability of New Source Review (NSR) under 6NYCRR Part 231-2. They must keep actual NOx emissions below 100 tons for each 12 month rolling period.

The Department is seeking public comment prior to making a final decision on permit issuance. A draft permit is available for review.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department has made a tentative determination to approve an application for the construction of a medical office park consisting of approximately 62,500 square feet of office space at the intersection of Southwestern Blvd and Pleasant Ave in the Town of Hamburg. The proposed office park will result in 0.41 acres of impact to the regulated 100 foot adjacent area of NYSDEC Freshwater Wetlands ED-23. Mitigation will consist of shrub plantings and seeding at a ratio of 1:1. As a tentative determination, the Department is seeking public comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of an activity for which a permit is sought.

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
