Project Description:

The applicant is proposing the removal and disposal of earthen materials, which are contaminated with paint sludge, within a section of the eastern stream bank of Torne Brook (NYS Water Index #: NJ 12-3, Class B) and its adjacent upland areas. This remedial action is being conducted in accordance with a NYSDEC issued Record of Decision (March 2014) and NYSDEC approved Final Remedial Design (July 2015). The project consists of the temporary installation of sedimentation and erosion controls, excavation of the contaminated materials, removal of the materials off-site to a solid waste facility authorized to receive such materials by the NYSDEC, and restoration of the project site. This project is located west of Torne Valley Road, approximately 0.1 mile north of the intersection of Torne Valley Road and Torne Brook Road.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

Evaluation using a Structural-Archaeological Assessment Form or other information has concluded that the proposed activity will not impact registered, eligible or inventoried archaeological sites or historic structures.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.
