Project Description:

The Department has made a tentative determination to approve an application to construct a 40 ft. by 46 ft. storage building on existing fill at an established transport facility, which will affect approximately 2100 sq. ft. of regulated adjacent area of Class 1 NYS Freshwater Wetland JA-3. As mitigation for wetland and regulated adjacent area impacts, the applicant proposes to enhance the remaining adjacent area by removal of historic fill piles, addition of topsoil and restoration of native, herbaceous vegetation. Native tree and shrub plantings will also be incorporated into the project as mitigation. There will be no encroachment or placement of fill beyond the existing limits of the facility's footprint. The project is located at the facility address listed above. As a tentative determination, the Department is seeking public comment prior to making a final decision on permit issuance.

Project Description:

The Department has made a tentative determination to approve an application for the milling and resurfacing of Goodrich Road from County Road to Lapp Road and full reconstruction of Goodrich Road from Lapp Road to Black Creek. Reconstruction of Goodrich Road includes widening the road within New York State Freshwater Wetland CC-44 and its regulated 100 foot wide adjacent area. A total of 0.33 acres of freshwater wetlands will be impacted and will be mitigated at a ratio of 1 to 1 in nearby Freshwater Wetland WO-28 at Beeman Creek Park. As a tentative determination, the Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of an activity for which a permit is sought.

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department has prepared a draft permit (NY 0000400) and made a tentative determination to approve this permit modification to the current permit's 5-day carbonaceous biochemical oxygen demand [CBOD5] limit at Outfall 001 to winter and summer specific limits. The summer limit [June 1- Oct 31] will stay at 5 mg/l; the winter limit [Nov 1- May 31] will be set at 15 mg/l. This modification is outlined in the Alternatives Evaluation Engineering Report of Sept 29, 2014 and by the full scale pilot testing results of Jan 21, 2015 to April 8, 2015. The higher CBOD5 limit is satisfactory in the winter months due to lower ambient stream temperatures, higher dissolved oxygen levels, lower decay rates, cessation of nitrogenous oxygen demands and an increase in stream flow. The dissolved oxygen discharge limit will remain at 7.0 ppm year round. Life Technologies Corporation is located at 3174 Staley Road in the Town of Grand Island. As a tentative determination, the Department is seeking public comment prior to making a final decision on permit issuance. A draft permit is available for review.
