The applicant proposes to stabilize approximately 170 feet of eroded Hudson River shoreline with large rock rip-rap at a 1-foot on 2-foot slope. The applicant also proposes to replace approximately 75 feet of deteriorated concrete bulkhead within a lateral side berth with new steel bulkhead that will be placed in the same location as the existing structure.

The applicant proposes to renew and modify an existing mined land permit to continue operation of a 12.2 acre life-of-mine consolidated bluestone mine of which 8.4 acres are to be disturbed during the upcoming permit term and to mine 20' deeper within the LOM. Blasting and the mechanical cutting of stone is proposed as well as importation of organic products such as wood chips, composted organic material, composted farm manure, hay or straw, to manufacture topsoil to amend existing subsoil to facilitate reclamation of the mine. The site is located west of Cummings Road approximately 5,000 feet southwest of East Masonville.

Project Description:

The applicant proposes to operate a 5.9± acre life-of-mine (LOM) consolidated bluestone mine, of which a total of 4.5 acres will be disturbed during this initial permit term. The site is an existing bluestone quarry and the current affected area is 3.2± acres. The site was previously mined prior to April 1, 1975. Additionally, the applicant has previously held a bluestone exploratory authorization for this location.

Processing will include periodically contracted crushing and screening. There is no dewatering proposed and no off-site discharge.

The mine is located 0.75 miles east of Sands Creek Road in the Town of Tompkins, approximately 0.5 miles north of the border with the Town of Hancock.

Project Description:

The applicant proposes to modify an existing permit to discharge 100,000 gallons per day treated sanitary wastewater to Sickles Creek, a class C waterbody. The sample type will be modified from 24-hour composite samples to 6-hour composite samples for three parameters (BOD5, suspended solids and ammonia nitrogen as NH3). The Department has made a tentative determination to issue a modified permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulatory activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project. A draft permit is available for inspection and comment at the Region 4 office. Refer to this application number listed above and SPDES number NY 0027359.
