Project Description:

The project involves the implementation of interim remedial measures at the Lehigh Alsen Dust Disposal Facility, Omega and Beta Piles to control releases of cement kiln dust to soil, sediment, surface water or groundwater, which includes impacts to the adjacent area of NYS Regulated freshwater wetland HS-101. Omega pile: Placement of rip-rap on geomembrane in existing drainage channels to divert stormwater, install a rip-rap outlet, install a seep collection system including sub-surface drains, which will drain to a new pump station and then to the existing collection pond. Temporary impacts within the adjacent area are 5,300 sf and permanent impacts are .53 acres. 1,150 CY of fill will be installed to support construction of an access road. Beta Pile: Enhancement of a natural erosion feature by creating a t-shaped, lined drainage channel 180 ft. by 100 ft. with rip rap on a geomembrane textile to slow runoff, and construction of a rip rap outlet to disperse flows. Activities will result in 0.05 acres of temporary and 0.03 acres of permanent impact. Temporarily disturbed areas will be restored to pre-construction contours, covered with clean soil and vegetated.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant proposes a discharge of 150 gpd of treated sanitary and floor drain waste through 2 outfalls which discharge to a sand filter system and an unnamed drainage ditch to a tributary to the Quackenkill. The discharge is proposed from the existing DOT Highway Garage, located at 42 Brick Church Road in Brunswick. The Department has made a tentative determination to issue a permit for a State Pollutant Discharge Elimination System (SPDES) permit under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project. SPDES #NY-0282421
