Project Description:

In accordance with New York City's 2007 Filtration Avoidance Determination, the applicant proposes to include an expansion of the Watershed Land Acquisition Program to include City-funded Flood Buyout Program. The program is designed to provide funding to acquire flood hazard properties that have not met the Federal or State buy-out criteria. Any property proposed for acquisition under this Flood Buy Out Program will be reviewed and approved, conditionally approved, or rejected by the municipality that the property is bounded by. The applicant has applied for a modification of Special Condition 7b of the Water Supply Permit to include City-funded buyouts. Like the Federal (FEMA) or State funded buy-out programs, properties in the City Funded buyouts would not need to meet the minimum size criteria or natural features criteria which are otherwise required under the Extended Land Acquisition Program, nor would such parcels be subject to the acquisition exclusions (designated hamlets and village areas). Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYC Dept of Environmental Protection

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Nov 02, 2015.
