Project Description:

The New York State Department of Environmental Conservation (DEC) is proposing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY0202959), pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS).

The Bailey Manufacturing Company manufacturers automotive stamping/components for the automotive industry. Some parts require metal finishing. The facility discharges to groundwater through the following: Outfall 001-process wastewater; Outfall 002-sanitary wastewater; Outfall 003-stormwater. Treatment is provided for Outfalls 001 and 002.

The following changes to the permit are proposed: Discharge Notification Requirements have been added; Industrial Best Management Practices have been updated; A Short Term High-Intensity Monitoring requirement has been added to assess the levels of parameters in the effluent wastewater. The permit includes updated forms and the latest general conditions. Details of changes are specified in the draft permit and fact sheet.

Project Description:

The Department has made a tentative determination to modify and renew the existing Air State Facility Permit for the Ashland Advanced Materials facility located in Niagara Falls, New York. The facility produces carbon and graphite engineered materials and the final product is a rigid fiber board.

The modifications include the addition of an L&L Bake Oven for processing materials produced at the facility and the installation of a new chlorine-based carbon fiber purification process.

Potential emissions of volatile organic compounds (VOC) and phenol, a hazardous air pollutant (HAP), exceed the major source thresholds of 50 and 10 tons respectively. Therefore, Ashland employs thermal oxidizers to reduce emissions to less than the major source thresholds. A federally enforceable emissions cap was established through the initial permit for this facility limiting VOC, phenol and total HAP emissions through control equipment efficiency and production limits. As a minor source the facility is not subject to the Title V permitting requirements of 6NYCRR, Part 201-6 and 40 CFR Part 70 and the New Source Review requirements of 6NYCRR, Part 231-2.

As a tentative determination, the Department is seeking public comments prior to making a final decision on permit issuance. A draft permit is available for review.
