Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue an Air State Facility permit for 20 Hudson Yards ("The Facility"). The Facility consists of five towers - Tower A (500 West 33rd Street) and Tower C (501 West 30th Street), both office towers with a Retail Podium Building between them (500 West 33rd Street), a residential building Tower D (553 West 30th Street), and one mix-use Hotel/Residential building Tower E (560 West 33rd Street). The Combined Heat and Power (CHP) plant will be constructed in the Retail Podium Building.

The Retail Podium will house four (4) natural gas fired GE Jenbacher engines with selective catalytic reduction and oxidation catalyst control equipment rated at 3.3 MW each in Emission Unit 00001 limited to 0.078g/bhp-hr, and six (6) 14.47 MMbtu/hr natural gas fired boilers. Operation of twelve (12) No. 2 fuel oil engine generators in Emission Unit 00002 are limited to a maximum of 130 hours/year of operation per engine (testing, maintenance, and any use for demand response/load shaving & when the other sources of power is not available) with NOx emissions limited to 0.67 g/kw-hr.

The facility's NOx emissions are limited to 49,800 pounds per year, during any rolling twelve month period. Records demonstrating compliance with this cap will be kept in accordance with the permit special conditions. The facility is subject to the provisions of State Facility requirements specified under 6 NYCRR 201-7. The Air State Facility permit contains a listing of the applicable federal, state, and compliance monitoring requirements for the facility. The application, draft permit, relevant supporting materials and regulations are available for review during normal business hours at the DEC office provided in this notice. Comments of support or objection may be made by filing a written statement by the deadline date indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objections raised. Hearing notices will contain instructions on filing for party status and submitting comments.

This project is subject to the Department's Environmental Justice Policy and an enhanced public participation plan has been prepared and accepted as a component of application completeness. State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

Based on the information provided in cultural resources survey reports for this project, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have an impact on registered or eligible archaeological sites or historic structures. Measures have been undertaken in consultation with OPRHP to avoid or mitigate impacts to registered or eligible resources. These agreed upon measures conclude the SHPA review.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant proposes the construction of a one-family, two-story plus basement detached residence entirely within the adjacent area of NYSDEC regulated Class II Freshwater Wetlands AR-29 (Annadale North). The applicant proposes to establish a 5 foot wide planted buffer along the rear property line as a deed restricted vegetated area of no land alteration. Sanitary waste will be discharged to a connection in Rensselaer Avenue. Approximately half of storm flows will be surface discharged towards the wetland, with the balance discharged into the storm sewer system fronting the property. The project site is located 200 feet west of Delmar Ave. Rensselaer Ave., Block 6301, Lot 58.

No further review in accordance with SHPA is required.

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
