Public Notice

The New York State Department of Environmental Conservation (NYS DEC) has received a Brownfield Cleanup Program (BCP) application from CPG Phase III Limited Partnership for a site known as Cottage Place Gardens Phase 3, site ID #C360150. This site is located in the City of Yonkers, within the County of Westchester, and is located at 8 Cottage Place and 209 Warburton Avenue. Comments regarding this application must be submitted no later than October 2, 2015. Negative Declaration

Putnam County - The Town of Southeast Town Board, as lead agency, has determined that the proposed Local Law to Amend Chapter 138 of the Town Code, Zoning will not have a significant adverse environmental impact. The action involves the adoption of a local law to amend Chapter 138 of the Town Code, Zoning and to update the Zoning Map to implement the recommendations of the Comprehensive Plan of the Town of Southeast. The Town Board of the Town of Southeast has embarked upon a process of updating its local land use regulations to protect the community character and environmental quality of the Town, and to promote contextual economic development. In 2014, the Town of Southeast updated its comprehensive plan, which had last been updated in 2002. In the 2014 Comprehensive Plan Update, the Town established a desire to rework the commercial zoning regulations to better balance community character and natural resource protections with the needs of the existing business community and the economic benefits that they bring to the Town. The Comprehensive Plan Update recommended that the Town seek to retain and enhance existing commercial development within the Town by legalizing existing uses that are non-polluting in nature and simplifying paths to redevelopment and property improvement. In addition, the Town should maintain and expand design guidelines for commercial properties, while broadening the allowable use categories within the Town to allow uses not previously considered. This Local Law seeks to implement these aspects of the 2014 Comprehensive Plan Update. The project is located throughout the Town of Southeast, New York.

Ulster County - The New York State Department of Environmental Conservation (NYS DEC), as lead agency, has determined that the proposed Beaverkill Fish Habitat Enhancement Project - Area D, Area G/H, Area I, Area K, and Area L will not have a significant adverse environmental impact. The action involves a proposal by the Beaverkill Stream Club for six (6) distinct fish habitat enhancement projects within six (6) areas all within an approximately three (3) mile stretch of the Beaver Kill [Water Index # D-70-20, Class C(T)]. Specific activities within the six project sites include: 1) Area D - Remove check dam, Install 1 cross vane, 2 J-hook rock vanes, 2 log vanes, 3 rock habitats; 2) Area G and H, Sites 13, 14, 15, and 16 - Remove check dam, Install 1 cross vane, 4 J-hook vanes, ~ 300 LF and ~ 150 LF toewoods; 3) Area I, Site 18 - Remove check dam, Install 1 cross vane, 1 J-hook rock vane; 4) Area J - Remove 2 check dams, Install 2 cross vanes; 5) Area K - Remove 2 check dams, 2 cross vanes; and 6) Area L, Site 20 - Remove check dam, Install 1 cross vane. The project is located on the Beaver Kill between approximately 1 mile northwest to 2 miles southeast of the Alder Road and Beaverkill Road intersection in the Town of Hardenburgh, New York.

The action involves a proposal by the Beaverkill Mountain Club for nine (9) distinct fish habitat enhancement projects within three (3) areas all within an approximately 1 mile stretch of the Beaver Kill [Water Index # D-70-20, Class C(T)]. Specific activities within the nine project sites include: 1) Area Q, Site 32 - Remove check dam, Install 4 J-hook rock vanes, Excavate Pool and Rebuild point bar; 2) Area Q, Site 34 - Remove check dam, Install 2 J-hook rock vanes, Excavate Pool and Rebuild point bar, Pull some trees down from slope failure; 3) Area R, Site 35 - Excavate and Enhance pools, Install 5 J-hook rock vanes, 3 log vanes; 4) Area R, Site 36 - Excavate Pool and Rebuild point bar, Install 315 LF of Toewood, 2 J-hook rock vanes, 2 log vanes; 5) Area R, Site 37 - Install Habitat rocks; 6) Area R, Site 38 - Install 1 rock cross vanes; 7) Area S, Site 40 - Install 1 J-hook rock vanes, 3 J-hook log vanes, Define low flow channel; 8) Area S, Site 41 - Install 2 J-hook rock vanes; and 9) Area S, Site 41 - Install 3 rock vanes; Prop up 2 mature trees with large rock, extend length of pool. Placement of 0.7 acre of fill within a federally regulated wetland for the purpose of constructing an all-purpose athletic field. The project is located on the Beaver Kill approximately 1,800 feet southwest to 3,200 feet northeast of the Barnhardt Road and Beaverkill Road intersection in the Town of Hardenburgh, New York.

Notice of Acceptance of Final EIS

Orange County - The Town of Wallkill Planning Board, as lead agency, has accepted a Final Environmental Impact Statement on the proposed Maple Fields II. The Final EIS is available from the Town of Wallkill Town Hall, Planning Board Office, 99 Tower Drive, Middletown, NY 10941 and on line at: www.engineeringpropertiespc.com.

The action involves a conservation subdivision development of 60 clustered townhome units with associated infrastructure and recreational amenities on approximately 24.4 acres of land. All of the townhomes will be constructed on the part of the lot located west of Schutt Road. These townhomes will be located on their own fee simple lots, with a minimum lot area of 3,000 square feet. Each townhouse will have three bedrooms, two and a half bathrooms and a two car garage. Units will range in size from approximately 2,230 to 2,350 square feet of livable area. The livable area includes a finished basement but excludes the garage area. The remaining common area land parcel, on the west side of Schutt Road will be owned and maintained by a Home Owners Association (HOA) and will contain the infrastructure and amenities serving the development.

The project proposes three access points, one originating at Maple Fields Drive and the other two beginning at Meadow View Drive. The internal road network contains several looped streets. All buildings will be served by Town of Wallkill water and sewer utilities. Stormwater runoff will be collected in a network of structures, pipes, and swales. Runoff will be conveyed to on-site stormwater treatment and retention/detention facilities. Gas and electric services will be provided by Orange and Rockland Utilities, Inc. Solid waste will be removed from the site by a private refuse hauling company contracted by the HOA.

The portion of the parcel on the east side of Schutt road is approximately 13.57 acres and is designated as the Conservation Area of the proposed Conservation Subdivision. The Conservation Area will be gratuitously offered for dedication to the Town of Wallkill to be used in accordance with the conservation subdivision regulations Section 249-80 I.

The project is located at 33 Schutt Road in the Town of Wallkill, New York.

Notice of Acceptance of Final Environmental Impact Statement for the Belleayre Mountain Ski Center Unit Management Plan (UMP)

Ulster County - The New York State Department of Environmental Conservation (NYS DEC), as lead agency under 6 NYCRR Part 617 State Environmental Quality Review Act, has accepted the Final Environmental Impact Statement (Final EIS) for the Belleayre Mountain Ski Center Unit Management Plan.

Project Description: The NYS DEC and New York State Olympic Regional Development Organization (NYS ORDA) have prepared a revision to the Belleayre Mountain Ski Center UMP that provides for the following actions: installation of three (3) new ski lifts; replacement of two (2) existing ski lifts; addition of sixteen (16) new ski trails; construction of up to three (3) additional parking areas; expansion of the existing Discovery Lodge and Sunset Lodge; construction of the following new structures: the Tomahawk Lodge, an Information Booth, a salt storage building, an additional snowmaking pond, installation of snowmaking piping, a lower pumphouse, and a compressor facility; modification of existing pumphouses; the acquisition and classification of the parcel of land that was the site of the former Highmount Ski Center; reclassification of 149 acres of the Ski Center's Intensive Use Area to a Wilderness designation; and classification of 263 acres of Forest Preserve land as an addition to the Ski Center's Intensive Use Area.

The project site is located in the Town of Shandaken (Ulster County) within the boundaries of the New York State Catskill Park. The proposed project is adjacent to the State-owned Forest Preserve Lands comprising the Shandaken Wild Forest and Big Indian Wilderness Area.

Project Description: The applicant, Crossroads Ventures, LLC, proposes a development known as the Modified Belleayre Resort at Catskill Park, which includes the Wildacres Resort and Highmount Spa Resort. Wildacres Resort is located on approximately 254 acres on the eastern side of the Project site, west of the Belleayre Mountain Ski Center, and would include an 18 hole golf course, a 250 unit hotel, and 163 lodging units in multi-unit buildings. Highmount Spa Resort is located on a portion of the approximately 237 acres that includes the site of the former Highmount Ski Area. Development proposed for the Highmount Spa Resort includes a 120 unit hotel with spa facilities and 53 fractional ownership units. Also proposed is a multi-level lodge building containing 27 fractional ownership units and 16 detached lodging units in 8 duplex buildings.

The project site is located in the Towns of Shandaken (Ulster County) and Middletown (Delaware County) within the boundaries of the New York State Catskill Park. The proposed project is adjacent to the State-owned Belleayre Mountain Ski Center and within the New York City Pepacton Reservoir watershed.
