Project Description:

The Department has received a request for renewal/reissuance of the facility State Pollutant Discharge Elimination System (SPDES) Permit for a surface discharge 260 gallons per day of treated sanitary wastewater to an unammed Class "C" tributary of the Normanskill Creek, from a septic tank and sand filter system at the applicant's facility located at 29 Old River Road (Lot 13), Town of Bethlehem (Glenmont), Albany County, New York.

The Department has made a tentative determination to re-issue this SPDES permit under Article 17 of the Environmental Conservation Law maintaining the effluent limitations and monitoring and report requirements as authorized under the previously issued permit. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project.

Project Description:

The applicant proposes to construct an approximately 1640 foot long walking path between Kingston and Main Streets, construct a 70 foot long boat launch, construct stormwater retention basins, install 85 linear feet of stone riprap for bank stabilization, and remove approximately 520 linear feet of invasive species along the bank of the West Branch of the Delaware River. The project is located the along right (north) bank of the West Branch of the Delaware River, between Kingston Street and 124 Main Street, in the Village of Delhi.

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a modification of the company's current Title V operating permit. The modified permit will add federally enforceable emissions limits for Oxides of Nitrogen (NOx) for several boilers used at the facility and would require the use of more natural gas to fire the boilers rather than No. 6 fuel oil. The modified permit would also require the completion of source testing of the boilers to determine actual NOx emission rates.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing.
