Project Description:

The applicant proposes to consolidate the existing Reed Bank mine (8.6 acres) and Perry Pit Mine (106.1 acres), and to remove 33.6 acres from the consolidated mine boundary for a new life of mine of 81.1 acres. The project also includes lowering the mine floor in Phase 3 from 272' to 260'. The project is located on the west side of State Route 40 between Turner Rd. and Irish Rd. in the Town of Schaghticoke, Rensselaer County.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a renewal Air Title V Permit for the operation of the existing Compressor Station 249 facility located at 2840 Highway Route 20, Town of Carlisle, County of Schoharie, owned by Tennessee Gas Pipeline Company, 1001 Louisiana Street, Houston, Texas.

The initial Title V permit for the facility, a natural gas compressor station, was issued on September 7, 2000. The facility currently includes four natural gas powered engines that are used to power compressors for pipeline transportation. The applicant has agreed to permit conditions which limit the emissions of oxides of nitrogen and carbon monoxide from two engines to avoid the applicability of 40 CFR 52.21, Subpart A. The applicant has also agreed to permit conditions which limit the emissions of oxides of nitrogen and volatile organic compounds (VOC) from the two newer engines below 40 tons per twelve month period for each contaminant to avoid the applicability of 6 NYCRR Part 231-2.2. The facility will continue to limit the VOC emissions from the newer engines through the use of oxidation catalysts for the primary purpose of reducing carbon monoxide emissions in order to achieve compliance with 40 CFR 63, Subpart ZZZZ - National Emission Standard for Hazardous Air Pollutants for Stationary Reciprocating Internal Combustion Engines. The applicant will continue to be required to maintain records and report this data to verify compliance with permit conditions and limits.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below.
