Project Description:

The Department has made a tentative determination to approve an application for renewal of an Air State Facility (ASF) Permit. Dresser-Rand Olean Operations manufactures gas turbines and centrifugal compressor products used in oil and gas production, oil and gas transmission, and refining. The facility is located in the City of Olean in Cattaraugus County. This permit covers machining, welding, assembly, testing, boilers, painting and a maintenance shop spread among the two plants on the property.

The permit contains emission caps for VOCs, NOx, total HAPs, and CO emissions to remain below the Title V permit applicability requirements. The changes made to this permit from the last permit include the addition of a 95 ton cap for CO, an increase in the VOC cap from 9.5 tons to 45 tons, and an addition of a third paint spray booth. The surface coating of miscellaneous metal parts are no longer allowed to cap VOCs to stay below the applicability requirements of the surface coating process regulation, 6 NYCRR Subpart 228-1, therefore, the facility's VOC limit has been increased to remain below Title V applicability only. The NOx emission cap remains at 95 tons and the total HAP cap remains at 23 tons.

Comments of support or objection may be made by filing a written statement by the deadline date indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objections raised. Project Description:

The Department has prepared a draft permit (NY-0029769) and made a tentative determination to approve the applicant's proposed modification authorizing the use of treated and disinfected sewage effluent to irrigate the Chautauqua Golf Club course. The Chautauqua Golf Club pumps the treated wastewater effluent into an existing irrigation pond on the golf course through existing Outfall 002. Project Description:

The applicant has applied for an Initial Permit for the continued withdrawal of up to 25 million gallons per day (MGD) of water from Lake Erie for the operation of the Buffalo River Improvement Corporation pump station, which distributes non-contact cooling water to the PVS Chemical Solutions facility located along the Buffalo River. The pump station has been in operation since 1967. No changes in current operations from recent years are proposed. The Department has determined that the facility is eligible for an Initial Permit under Section 15-1501(9) of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 GPD which were properly reported to the Department on or prior to February 15, 2012. Section 15-1501(9) requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "Initial Permits" under ECL 15-1501(9) as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

The applicant proposes approximately 325 linear feet of bank stabilization utilizing slope and toe rock riprap protection along the eroded bank on the park side of the stream and repair of three existing rock stream barbs. Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) and renewal to the State Pollutant Discharge Elimination System (SPDES) Permit (NY0021504) pursuant to 6 NYCRR Part 750-1.18 and 750-1.19, the priority ranking system known as New York State's Environmental Benefit Permit Strategy (EBPS). This modification will also serve to renew the SPDES permit, the term of which was extended under the State Administrative Procedures Act (SAPA).

The Village of Warsaw Wastewater Treatment Plant discharges an average flow of 0.58 million gallons per day (MGD) of treated sanitary wastewater into Oatka Creek, a class C waterbody. Treatment consists of screening, grit removal, primary settling, bio-towers (trickling filters), and final settling.

The proposed modifications to this permit include: revision of the pH range limit to 6.5-8.5 standard units (SU); the reduction of seasonal Ammonia limits to 1.1 mg/l from June 1 to October 31 and to 2.8 mg/l from November 1 to May 31; the addition of a seasonal effluent limit of 7.0 mg/l for Dissolved Oxygen from June 1 to October 31; and the addition of a Mercury Minimization Program. Additionally, the general conditions contained within the permit have been updated.

The Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. A draft permit is available for review.
