Project Description:

The Department has made a tentative determination to approve this application to modify a SPDES permit (SPDES# NY 003 0261) to decrease an existing 100,000 gallon per day (gpd) surface discharge of treated sanitary wastewater to 80,000 gpd from the Town of Liberty Loomis Sewer District wastewater treatment plant (WWTP) into Loomis Creek, Class B(t). In addition, the modification would change the effluent limit for phosphorus to the requirement for monitoring on a monthly basis. The WWTP upgrade project is being constructed to comply with requirements of the Schedule of Compliance contained in an Order on Consent [#R3-20110621-73] executed in 2012 with the Town of Liberty. The first phase of the WWTP upgrade was completed in 2014. This permit modification will allow completion of the WWTP upgrade. The second phase of the upgrade includes construction of a new 50,000 gpd rotating biological contact (RBC) treatment system with clarifier, chemical feed system and sludge pump station which will operate in parallel with the existing 50,000 gpd RBC system, and replacement of sand within existing sand filters at the plant. The project is located northwest of the intersection of Loomis Road and NYS Route 52 in the hamlet of Loomis. A draft permit is available for inspection and comment at the regional office.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Sep 11, 2015.
