Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 4,250,000 Gallons Per Day (GPD) of water from Honeoye Inlet and snowmaking reservoir for operation of the Hunt Hollow Ski Club Facility. The facility has been in operation in recent decades. No changes in current operations are proposed.

The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 GPD which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

Hanson Aggregates NY LLC is applying for an air state facility permit to replace its current air certificates to operate in order to continue to process aggregate, lime and hot mix asphaltic concrete at its currently permitted location in Honeoye Falls, NY. The Standard Industrial Classifications representative of this facility are 2951 & 1422.

Please note the currently proposed mine expansion is being processed separately and will include a separate public notice and comment period at a later date.

Hanson operates a 4-ton Cedar Rapids hot mix asphalt (HMA) batch plant, a Gencor drum HMA and a portable CMI/UVM - 1700 5-ton HMA drum plant. Each plant fires #2 fuel oil and/or waste oil, and includes a bag house control device. Each plant consists of a rotary aggregate dryer, elevator, hot screens, hot bins, weight hopper, mixer and truck load out station. In order to "cap out" of major source status, the facility has accepted annual emission limits of 98 tons per year on both Carbon Monoxide (CO) and Nitrogen Oxides(NOx), below the 100 ton thresholds established in 6 NYCRR Part 201.6 (Title V). Actual emissions are recorded monthly and records of 12-month rolling totals are required. By accepting these limitations the facility emissions for CO, Sulfur Dioxide (SO2), NOx, Volatile Organic Compounds (VOC), and Hazardous Air Pollutants (HAP) will all be less than their respective major source thresholds.

In addition to the operating limits mentioned above, the facility must meet the sulfur in fuel limits of 6 NYCRR Part 225-1, the opacity and particulate limits of 6 NYCRR Part 212, the New Source Performance Standards for Non-metallic Mineral Processing Facilities of 40 CFR 60 Subpart I and the National Emission Standards for Hazardous Air Pollutants 40 CFR 63 Subpart ZZZZ for stationary reciprocating internal combustion engines.

The draft permit is available for review at the Region 8 NYSDEC office in Avon.
