Project Description:

The NYS Department of Environmental Conservation (DEC) is proposing a Department Initiated Modification to the State Pollutant Discharge Elimination System (SPDES) Permit NY0036986, pursuant to 6NYCRR Part 750-1.18.

The DEC proposes to add disinfection requirements for the treatment of plant effluent to better protect public health in compliance with DEC guidance (TOGS 1.3.3). A Schedule of Compliance for installing disinfection treatment units have been added which requires that the system be operational by 05/01/2019. As part of this modification, the General Permit requirements section has been updated in accordance with State and Federal Regulations.

Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department proposes to renew the RG&E Hazardous Waste Management Corrective Action Only Permit at the existing RG&E Brooks Avenue facility, a former RCRA hazardous waste transfer, storage and disposal facility. The renewed permit would authorize continued corrective action activities (including investigation, Corrective Measure Studies, Corrective Measures Implementation) at areas where a final remedy has not yet been selected including AOC 4 (Gasoline of Unknown Origin Floating on Groundwater), AOC 5 (Erie Canal Bank), and AOC 7 (Vapor Intrusion Contamination). (See Module II of the draft permit for more details.) RG&E continues to manage hazardous waste as a regulated large quantity generator. As a tentative determination, the Department seeks comments on the draft permit prior to making a final decision. Project Description:

The Department has made a tentative determination to authorize a proposed temporary disturbance for maintenance activities on the existing Enterprise TE Products Pipeline, located in the Catharine Creek Wildlife Management Area, within regulated freshwater wetland (FWW MF-1, Class 1). The applicant proposes to excavate a 12 x 12 x 6 foot deep area, utilizing a Caisson Box measuring 13-feet high, resulting in temporary placement of 32 cubic yards of soil on wooden construction mats in wetland, for a total estimated temporary impact of 0.46 acres of wetland. Limited use of marsh hoe (an amphibious vehicle) will be required within the wetland to get equipment to and from the location. The work will be done within restrictive dates to prevent impacts to breeding birds. The file is available for review and comment at NYSDEC Region 8.
