Project Description:

The applicant proposes to construct a subsurface septic system with a design capacity of 2,700 gallons per day to treat sanitary and process wastewater from a proposed micro-brewery, taproom, and apartment. The Department has made a tentative determination to issue a State Pollutant Discharge Elimination System Permit under Article 17 of the Environmental Conservation Law for this project. This tentative determination indicates that the discharge regulated under this statute will satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project. A draft permit is available for inspection and comment at the Region 4 office.

Availability of Application Documents:

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Aug 21, 2015.

Project Description:

The applicant proposes to excavate two potholes measuring approximately 0.5 acres within Class 2 Freshwater Wetland SS-3. Proposed potholes will have a maximum depth of 4 feet, with side slopes of no more than 6:1. Side slopes are proposed to be seeded with a mixture of native emergent wetland species. Excavation is proposed to be conducted using specialized equipment for work in the wetlands. Approximately 2400 CY of material will be removed to an adjacent upland area where it will be leveled, allowed to dry, and seeded with an upland conservation mixture.

The applicant also proposes to release and monitor Galerucella beetles into the marsh for at least two consecutive years to minimize the spread of purple loostrife. To minimize the introduction of invasive species, all equipment will be decontaminated at the contractor's yard before mobilization to the side. The applicant also proposes a plan for potential Phragmites intrusions via mechanical control methods and chemical control methods if mechanical control is ineffective.
