Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue an Air State Facility (ASF) Permit for an existing medical center currently permitted as an Air Title V (ATV) facility under permit #2-6005-00011/00004. The ATV permit will be discontinued upon ASF issuance. The facility operates four 30 MMBtu/hr Johnston boilers (natural gas & #2 oil), two 10.46 MMBtu/hr York Shipley boilers (natural gas only), two 4.47 MMBtu/hr Weil-McLain boilers (natural gas & #2 oil), two 1.68 MMBtu/hr York Shipley boilers (natural gas & #2 oil), two Steris EtO sterilizers with one common Amsco Eagle abator, eleven emergency generators, eighteen fuel oil storage tanks and several laboratory fume hoods. The boilers fire natural gas (Process NG1) and #2 fuel oil (Process OL2).

In order to comply with the 2014 NOx RACT regulations that require reducing the NOx emission rate to 0.08 lbs/MMBtu, the facility is planning to downgrade the permit level to an ASF permit by capping the annual rolling NOx emissions to below 25 tpy. The decision is based on past years of fuel consumption and therefore, the NOx emissions have been well below 25 tpy. There are no other changes to the equipment (source of emissions) inventory or operations at the facility.

The facility operates other sources which are considered exempt from permitting in accordance with 6 NYCRR 201-3.2(c), including eleven turbo charged diesel-fired emergency power generators (<500 hours/yr), eighteen distillate fuel oil storage tanks with storage capacities <300,000 bbls; and several ventilating and exhaust system for laboratory operations.

The facility is subject to the provisions of State Facility requirements specified under 6 NYCRR 201-7. The Air State Facility permit contains a listing of the applicable federal, state, and compliance monitoring requirements for the facility. The application, draft permit, relevant supporting materials and regulations are available for review during normal business hours at the DEC office provided in this notice. Comments of support or objection may be made by filing a written statement by the deadline date indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objections raised. Hearing notices will contain instructions on filing for party status and submitting comments.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Aug 21, 2015.

Project Description:

The applicant proposes to construct a 2-family house with garage, parking pads, wood deck and dry wells. Mitigation for project impacts is a hedgerow buffer planting area. The project site is located within NYSDEC regulated Class I Freshwater Wetland NA-7 (South Beach), at 31 Lansing Street, Staten Island, Block 3405, Lot 25.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Comments on this project must be submitted in writing to the Contact Person no later than Aug 12, 2015.
