The applicant is proposing disturbances to the regulated 100-foot adjacent area of NYS Freshwater Wetland MD-10, Class II, in association with the Saddle Ridge Residential Development (273 housing units, recreational facilities, connection to municipal water and sewer, and associated parking and access roads). The project site is situated on two parcels equaling approximately 215 acres, and the proposal includes 1.94 acres of disturbances to the regulated area resultant from the construction of two buildings, two access roads, stormwater retention structures and grading. The parcels are located on either side of Maples Road approximately 0.85 miles northwest of the intersection of Maples Road and Mud Mills Road.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. The report of the survey is on file. No archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 10,713,600 Gallons Per Day (GPD) of water from the quarry sump for operation of the East Kingston Quarry Facility. The mining and aggregate processing facility has been in operation in recent years. No changes in current operations from recent years are proposed.

The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 GPD which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

Project Description:

The applicant proposed disturbances within tidal wetlands and the Costal Erosion Hazard Area related to the replacement of an existing pier within the same footprint; the repair and modification of two sections of seawall; and the modification of the stone toe protection on a third section of seawall. Only the stone toe protection is within a mapped Coastal Erosion Hazard Area. There will be a small increase in fill below Mean High Water but no expansion of the footprint of any structure.
