Negative Declaration

Erie County - The Town of Amherst Town Board, as lead agency, has determined that the proposed Rezoning of 271 Tonawanda Creek Road will not have a significant adverse environmental impact. The action involves the rezoning and future development of 271 Tonawanda Creek Road in the Town of Amherst, New York. The subject property measures 34.15 ± acres and is located on the south side of Tonawanda Creek Road at the terminus of Daisy Lane and is generally bounded by East Summerset Lane on the west, Sundridge Drive on the east, and the Sunset Estates subdivision on the south. The Town's Creekwood Park makes up a portion of the property's north boundary. The petitioner proposes to rezone the site from Suburban Agriculture (SA) to Traditional Single-Family Residential District (TR-3) to permit the development of a 137 lot single-family subdivision. In addition to the area to be rezoned, the petitioner proposes to reserve a 20.8 ± acre area as a conservation area; this area contains NYS Wetland TE-38. Erie County - The Town of Amherst Town Board, as lead agency, has determined that the proposed Rezoning of 7 Properties to MFR-7 will not have a significant adverse environmental impact. The action involves the rezoning of seven (7) parcels that contain nursing homes or senior apartments within the Town of Amherst from Community Facilities (CF), Office Building (OB) and Residential District Three (R-3) to Multi-Family Residential District Seven (MFR-7). The purpose of the request is to insure that the existing residential developments on the subject properties remains conforming due to pending changes to the permitted uses in the CF district. No development is proposed with the rezoning. The petitioner is the Town of Amherst, 5583 Main Street, Williamsville, New York, 14221. The project is located at 165 South Union Road, 193 South Union Road, 200 Bassett Road, 400 Mill Street, 410 Mill Street, 795 and 815 (portion) Hopkins Road, and 4459 Bailey Avenue in the Town of Amherst, New York.

Erie County - The Town of Amherst Planning Board, as lead agency, has determined that the proposed Site Plan Review - 10 Curtwright Drive will not have a significant adverse environmental impact. The action involves the construction of a 55,000 ± square foot office, production and warehouse building in the rear portion of 10 Curtwright Drive located at the southeast corner of the Curtwright-Wehrle Drive intersection in the Town of Amherst, New York. The project will include new parking for 127 vehicles and bioretention/detention area for stormwater management.
