Project Description:

The applicant has applied for an initial permit for the continued withdrawal of up to 1,504,800 gallons per day (GPD) of water for operations at the South Bethlehem Quarry Facility. The water is used for stone washing operations and for dust suppression. The sources of water are from on-site ponds and wells. The Facility has been in operation more than a century and no changes in current operations are proposed.

The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 GPD which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant proposes to draw down the waters within Class 2 Freshwater Wetland A-20 in order to inspect the HT Vogel Pond Dam (#228-3612). Spaulding Furnace Brook, Class C(T), flows through FW A-20. The applicant proposes to draw down approximately 6.2 million gallons from the 6 acre pond by opening the valve, if operable, or by lowering water levels via a combination of pumps and siphons, and discharging the clean water downstream of the dam.

The applicant proposes to improve the dam outlet by creating a 20' long rip rap apron. Vegetation removal and excavation of two test pits measuring approximately 2' wide by 6' deep are also proposed on top of the earthen berm to determine the dam's condition. A licensed professional engineer will monitor the dam during dewatering, as well as the excavation and backfill/compaction of the two test pits.

Dewatering would occur over a four day period at an approximate 2.5 cubic feet/ second maximum rate. Approximately 6ft. of water would remain in the deepest part of the pond during draw down. The dam will then be inspected below the water line to determine if the dam will be repaired, replaced, or eliminated. The applicant proposes to maintain the lowered water levels for approximately one week until determinations/plans are made; after which, water levels will be returned to their pre-inspection depths.

The applicant has applied for an initial permit for the continued withdrawal of 3,909,600 Gallons Per Day (GPD) of water from a quarry sump and on-site wells for operation of the Pattersonville Facility. The dolostone mining and aggregate processing operation and asphalt production facility has been in operation in recent years. No changes in current operations are proposed.

The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law.
