Project Description:

The New York State Department of Environmental Conservation (NYSDEC) is pursuing a Department Initiated Modification (DIM) and renewal to the State Pollutant Discharge Elimination System (SPDES) Permit NY0025950, pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS). As a result of comments received from the permittee, this is a re-notice of the Notice of Intent to Modify published in Environmental Notice Bulletin on 6/4/2008 and 3/25/2009.

The Amherst SD #16 facility discharges treated wastewater via Outfalls 001, 002 and 03A. Outfall 03A is a Type I SSO and is prohibited from discharging except in emergency situations. Treatment at the facility involves two-stage pure oxygen system, aerated grit removal, carbonaceous BOD removal, nitrification, chemical removal of phosphorous, tertiary filtration and chlorination and dechlorination with discharge through Outfall 001. Sludge from the sludge thickening units goes to dewatering/drying, neutralization, then disposed of at landfill or incineration. The facility has a monthly average design capacity of 48MGD. The following changes to the permit are proposed: Forms have been updated incorporating the latest general conditions. Summer minimum receiving water flow has been revised. Seasonal limits page has been added. Ammonia limit, winter season, has been adjusted with a compliance schedule to allow time to meet limit. TRC limit, summer season, has been adjusted. Limits for certain parameters are replaced by action levels. Action levels for Bromoform, Chloroform, Dichloromethane have been removed as they were not present in sampling. New action levels have been added for certain parameters. Short term high intensity schedule for mercury has been added, along with a Mercury Minimization Program. A revised Outfall 002 discharge limits page has been added along with Overflow Retention Facility Special Conditions. A short discussion of Type I Emergency Outfall 003, Type 3 SSO's-Outfalls 08A, 10A, 12A that are being addressed by Order on Consent. A schedule of submittals has been added. Capacity, Management, Operation and Maintenance (CMOM) requirements have been added. Dechlorination schedule has been deleted as this work is complete. Whole Effluent Toxicity testing has been added. Discharge Notification Act has been added.

Project Description:

The applicant has applied for an initial permit for the continued withdrawal of 3,186,000 Gallons Per Day (GPD) of water from the Niagara River for operation of the IsleChem Facility. The chemical manufacturing facility has been in operation since 2001. No changes in current operations from recent years are proposed.

The Department has determined that the Facility is eligible for an Initial Permit under Section 15-1501.9 of the Environmental Conservation Law. Initial Permits are limited to existing facilities for existing water withdrawals over 100,000 GPD which were properly reported to the Department prior to February 15, 2012. Section 15-501.9 requires the Department to issue Initial Water Withdrawal Permits for the reported volume.

The Department has determined that the issuance of "initial permits" under ECL section 15-501.9 as implemented by 6 NYCRR 601.7 is a ministerial action and therefore subject to the Type II exemption set out in 6 NYCRR 617.5(c)(19).

Project Description:

The Department has received an application for the construction of a 1-story 3,260 square foot residential group home with four one-bedroom, one-bath apartments, a small staff office and meeting room in the regulated adjacent area of Freshwater Wetland (FWW) ED-18 on Southwestern Boulevard in the Town of Hamburg. The driveway and parking for the residence will be outside the adjacent area. The proposed project will impact approximately 0.25 acre of adjacent area and the remainder of the approximately 16.5 acre parcel, which includes a portion of FWW ED-18, will be preserved as mitigation for the adjacent area impact.

The Department has made a tentative determination to approve this application. As such, the Department is seeking public comment prior to making a final decision on permit issuance.

Project Description:

The Department has received an application for the construction and operation of a proposed biotreatment facility to treat petroleum impacted soils at the Tonawanda Landfill in the Town of Tonawanda. Approximately 7 acres of the site will be used for treatment and storage of the petroleum impacted soils. In addition, the applicant proposes to designate space within the relocated facility for temporary storage of leaves during the winter months. The Department has made a tentative determination to approve this application. As a tentative determination, the Department is seeking public comment prior to making a final decision on permit issuance.
